Hatch Baby, Inc. Employee/Job Applicant Privacy Notice

PURPOSE
This Privacy Notice (“Notice”) describes how Hatch Baby, Inc. (“Hatch,” “we,” “our,” or “us”) collects, uses, discloses, or otherwise processes Personal Information (defined below) related to employees and job applicants (“you” or “your”) before, during, and after your working relationship with us. By submitting a job application or accepting an employment offer from Hatch, you agree to the collection, use, and disclosure of your Personal Information as set forth in this Notice.
This Notice does not form any contract or guarantee of employment or other contract to provide services.
SCOPE
For purposes of this Notice, “Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a job applicant or employee.
This Notice does not apply to information that we may collect when you access Hatch digital properties as a consumer, make a purchase in-store or online, or otherwise act as a consumer of Hatch products or services. NOTICE AT COLLECTION OF PERSONAL INFORMATION
1. INFORMATION WE COLLECT ABOUT YOU
We collect the following categories of Personal Information from and about you:
- Identifiers/contact information, such as name, address, phone number, email address, government-issued identification numbers (i.e., social security number, passport number, driver’s license number), or other identifiers.
- Characteristics of protected classifications under federal or California law, such as your gender, date of birth, or citizenship or immigration status.
- Internet or other electronic network activity information, such as your system ID, access rights, network usage data, information generated through your use of a Hatch computer and communications equipment, including emails and instant messaging, for purposes of administering your working relationship with Hatch;
- Education information, such as education history, records, and credentials.
Professional or employment-related information, including:
- Employment history, references, skills, qualifications, previous compensation and benefits, and other information contained in your resume, application, or other documents you provide in support of your application;
- Materials submitted during the application process, including any assessments, interview assignments, work samples, project portfolios, or other information submitted or created to demonstrate your qualifications;
- Organizational data, such as employee type, employee photo, work location, division, department, and position level;
- Contract data, such as contract type, hire date, end date, non-disclosure agreements, reason for termination, and details on paid or unpaid leave;
- Compensation information, such as payroll records, bank account information, amount, currency, number of payments per year, details for participation in and administration of an equity plan, and applicable bonus and incentive plans;
- Information relating to your working relationship with Hatch, such as skills, qualifications, performance, promotions, demotions, and discipline;
- Working time data, such as absence, annual leave and payment records, time recording information, and other leave records;
- Expense administration, such as expense reports, and expense evidence entries;
- Benefits-related information, such as enrollment in employee benefits programs, contributions to health insurance, pension contributions, and your dependents' ages and genders;
- Performance data, such as performance evaluation and ratings; and
- Training information, such as training courses performed.
- Personal Information described in California Civil Code section 1798.80(e), including categories of Personal Information listed elsewhere in this Notice;
- Inferences derived from the above categories of Personal Information; and
- Sensitive Personal Information, including government-issued identification numbers, information about race/ethnicity or citizenship/immigration status, and certain information related to an employee’s health. We only collect and process “sensitive personal information” for permissible “business purposes” (as such terms are defined in applicable law), including assessing work and benefits eligibility, payroll, administering benefits, and monitoring our equal opportunity practices. We do not use or disclose sensitive personal information for the purpose of inferring characteristics about you.
Hatch may conduct a background check to collect additional Personal Information about you for employment purposes. Prior to conducting this check, we will provide you with a separate written notice and an opportunity to consent to the background check.
We take commercially reasonable steps to protect the confidentiality of the Personal Information we collect from disclosure to third parties, except on a need-to-know basis, for the purposes outlined in Section 2 of this Notice.
2. THE BUSINESS AND COMMERCIAL PURPOSES FOR COLLECTING AND USING YOUR PERSONAL INFORMATION
The specific purposes for which we use your Personal Information are described below.
- To facilitate the recruiting and interview process, including to make decisions about employment.
- To communicate with you regarding your application or employment status.
- To administer your working relationship with Hatch, including to provide you with compensation and other benefits, communicate with you, conduct personnel management, evaluate job performance, and deliver learning and development opportunities.
- To address disciplinary matters.
- To provide you with access to company resources necessary to carry out your responsibilities.
- To implement appropriate security and fraud prevention measures for our business, and ensure compliance with our rules and processes.
- To monitor use of our IT systems, including email, internet, intranet, mobile and landline phones, computers and tablets, including to gather evidence of any potential wrongdoing.
- To enable us to pursue our legitimate interest in operating our business.
- To contact your emergency contact in the case of an emergency.
- To comply with applicable laws and regulations and respond to lawful requests and communications from law enforcement and other government officials.
- To protect our rights, privacy, safety, property and/or those of you or others.
- To fulfill any other purpose for which you provide your Personal Information or as explained to you at the point of collection.
- For such other purposes as required by law or as deemed necessary by Hatch for the proper management of its employees and its business.
3. SALES AND SHARING OF PERSONAL INFORMATION
We do not “sell” or “share” your Personal Information as these terms are defined in applicable privacy law.
4. RETENTION
When you apply for a position with Hatch, we retain your Personal Information to consider you for the position you applied for or other positions with Hatch for a period of four years. If you are hired as an employee, we retain Personal Information for the length of your employment relationship with Hatch as well as for an additional four years after the termination of your employment relationship. We may retain certain Personal Information for a longer period to address a legal, health and safety, or tax-related obligation or to resolve a potential or actual dispute or investigation.
5. HOW YOUR PERSONAL INFORMATION IS COLLECTED
We or our service providers generally collect your Personal Information directly from you. We may also collect your Personal Information from your previous employer or references, from third parties such as employment agencies or background check agencies, or from public career sites (e.g., LinkedIn). We may combine the information we receive from and about you, and will process/protect the combined information in accordance with this Notice.
6. HOW WE DISCLOSE YOUR INFORMATION
Within Hatch, your Personal Information will be available to staff and human resources personnel on a need-to-know basis.
We may also disclose each category of your Personal Information that we collect with our affiliates for purposes set forth in this Notice, as well as our service providers that provide business, professional, human resources, hiring, payroll, or technical support services to us, help us operate our business and the Services, or administer activities on our behalf.
In certain circumstances, we may disclose each category of your Personal Information to:
- Business Contacts. We may provide a third party, such as a potential supplier or customer with a means of contacting you in the normal course of business by providing your business contact details (phone, email), title, or other relevant information.
- Competent Governmental, Regulatory, and Public Authorities. We may disclose your Personal Information to government and law enforcement authorities, in each case to comply with legal or regulatory obligations or requests.
- Relevant Third Parties as Part of a Corporate Transaction. In the event of a reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of our business, assets, or stock (including in connection with a bankruptcy or similar proceeding), we may disclose or transfer your Personal Information to certain third parties, such as the acquiring entity and its advisers.
- Other Third Parties. We will disclose your Personal Information to other third parties at your direction or with your consent, including former employers or those whom you have listed as job references or who referred you to Hatch. Additionally, we will disclose your Personal Information as we believe necessary or appropriate to: (a) comply with applicable law; (b) enforce our terms and conditions; (c) protect our operations; (d) protect our rights, privacy, safety, or property, and/or those of you or others; and (e) allow us to pursue available remedies or limit damages that we may sustain.
We may disclose your Personal Information for other reasons that we will describe at the time of information collection or prior to disclosing your information.
De-identified data: We may de-identify or aggregate Personal Information so that it will no longer be considered Personal Information and disclose such information to other parties for purposes consistent with those described in this Notice. We will never attempt to, and will take commercially reasonable efforts to prevent re-identifying Personal Information once de-identified.
7. YOUR PRIVACY RIGHTS
California privacy rights. If you are a resident of California, you are entitled to the following privacy rights, subject to applicable exceptions:
- Right to Know: You have the right to know what Personal Information we have collected about you, including the categories of sources from which the Personal Information is collected, the business or commercial purpose for collecting, selling, or sharing Personal Information, the categories of third parties to whom we disclose Personal Information, the categories of Personal Information disclosed to third parties, and the specific pieces of Personal Information we have collected about you.
- Right to Delete: You may request that we delete the Personal Information that we have collected from or about you. There are some instances when we will not be able to fully address your request, such as to perform a contract, to detect and protect against fraudulent and illegal activity, to maintain for internal purposes, to comply with a legal obligation or to exercise our rights, including our rights in managing employees.
- Right to Correct: You have the right to correct inaccurate Personal Information that we may maintain about you, subject to appropriate verification.

We may request certain information to verify your identity before we can respond to your request. When you exercise your privacy rights you have the right not to receive discriminatory treatment by Hatch.
To request information we may collect about you as a consumer, including purchases in-store or online or when you use our website, please follow the instructions provided in our consumer privacy policy.
Authorized Agent Requests. You may authorize someone to make a privacy rights request on your behalf (an authorized agent). Authorized agents will need to demonstrate that you’ve authorized them to act on your behalf. Hatch retains the right to request confirmation directly from you confirming that the agent is authorized to make such a request, or to request additional information to confirm the agent’s identity.
8. INFORMATION SECURITY
We implement and maintain reasonable security procedures and practices appropriate to the nature of the information we maintain, including appropriate technical, administrative, and physical measures designed to protect information from unauthorized or illegal access, destruction, use, modification, or disclosure. You also play an important role in protecting your information. It is your responsibility to select a strong password, change it regularly, not reuse or share your password, and alert us if you have any concerns about unauthorized use of your Hatch applicant or employee account.
9. CHANGES TO THIS NOTICE
We reserve the right, in our sole discretion, to change, modify, add, remove, or otherwise revise portions of this Notice at any time. We will communicate any material revisions to you by email.
